CRYOLITE Terms & Conditions

Please read these Terms & Conditions carefully before purchasing or using the CRYOLITE device (“Device”). By purchasing, using, or allowing the use of CRYOLITE, you agree to be bound by these Terms & Conditions.

1. General Use Restrictions

• CRYOLITE is sold exclusively for professional and business use (e.g., medspas, chiropractors, physical therapy clinics, wellness centers).
• The Device is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease. No medical claims should be made regarding its use.
• The Device must only be used for its intended purpose and strictly in accordance with the operating manual and training protocols.

2. Mandatory Training & Certification

• All operators must complete the official CRYOLITE Training & Certification Program before using the Device.
• Operation of the Device without certification is strictly prohibited.
• Any unauthorized or uncertified use voids the warranty and transfers all liability to the purchaser.

3. Safety & Approved Consumables

• Only approved food-grade CO₂ and CRYOLITE-provided accessories, parts, and consumables may be used.
• Use of unapproved gases, parts, or modifications will void the warranty and may result in serious harm, for which True Scale Medical assumes no responsibility.

4. Warranty

The CRYOLITE Device includes a two (2) year limited warranty covering defects in materials and workmanship under normal use.

This warranty does not cover:

• Damage caused by misuse, accidents, unauthorized repairs, or uncertified operation.
• Damage resulting from use of unapproved CO₂, parts, or accessories.

Warranty service is limited to repair or replacement of defective parts at True Scale Medical’s discretion.

5. Returns & Refunds

• CRYOLITE Devices may be returned within 30 days of delivery only if unopened, unused, and in original packaging.
• Opened, used, or installed devices are not eligible for return.
• All approved returns may be subject to inspection and restocking fees.

6. Limitation of Liability

• To the maximum extent permitted by law, True Scale Medical and its affiliates shall not be held liable for any injury, damage, or loss arising from misuse, uncertified operation, or unauthorized modifications of the Device.
• Indirect, incidental, or consequential damages, including loss of income, business disruption, or reputational harm.

The purchaser assumes full responsibility for the safe operation of the Device after delivery and certification.

7. Indemnification

Purchaser agrees to indemnify, defend, and hold harmless True Scale Medical, its officers, employees, and affiliates from any claims, damages, or expenses arising out of:

• Improper use of the Device.
• Failure to complete or enforce certification requirements.
• Use of unapproved consumables or unauthorized modifications.

8. Governing Law & Dispute Resolution

• These Terms & Conditions are governed by the laws of the State of California.
• Any disputes shall be resolved exclusively in the state or federal courts located in Sacramento County, California.

9. Acceptance of Terms

By purchasing or using the CRYOLITE Device, you acknowledge that you have read, understood, and agreed to these Terms & Conditions in full.
